Proposed Ordinance 165 - Depositing on Public Roadways

Notice of Public Hearing and Vote on Proposed Ordinance No. 165:

An ordinance amending Portions of CHApter 7 of the Frazee City Code

 

NOTICE IS HEREBY GIVEN that the City Council of the City of Frazee, Minnesota will hold a public hearing on January 25, 2023 at 4:30 p.m. or shortly thereafter, at the Frazee Event Center, located at 114 Lake Street North, Frazee, Minnesota, on proposed Ordinance No. 165, which would amend portions of Chapter 7 of the Frazee City Code.

 

The following amendments to the Frazee City Code are proposed:

 

7-1-1: DEPOSITS ON PUBLIC WAYS:

No person shall throw or deposit, or permit to be thrown or deposited, any snow, ice, dirt, paper, filth, the sweepings of any house, store, shop, or office, or any ashes, filthy water, offal, straw, wood, stones, earth, manure, or rubbish of any kind on or into any street, sidewalk, alley, or public ground in the city. 1-4A-1: GENERAL PENALTY 1 :

   A.   Misdemeanor Violation; Penalties: Any person who violates a provision of this code is guilty of a misdemeanor and, upon conviction thereof, may be punished by a fine of not more than one thousand dollars ($1,000.00) or imprisonment for a term not to exceed ninety (90) days, or both, but in either case, costs of prosecution may be added. Each act of violation and every day on which a violation occurs or continues is a separate violation.

   B.   Definition Of Misdemeanor And Petty Misdemeanor: A "misdemeanor" is an offense or crime that the city council is empowered to punish with fine or imprisonment; a "petty misdemeanor" is as defined by law.

   C.   Limitation; Compliance With Statute: The provisions of subsection A of this section notwithstanding, no penalty shall be greater than that established by state statute for the same offense. (2008 Code)
